王劍與慶城縣三十里鋪鎮雷旗村民委員會承包地征收補償費用分配糾紛上訴案

 被上訴人(原審被告)慶城縣三十里鋪鎮雷旗村民委員會。

 上訴人王劍因與被上訴人慶城縣三十里鋪鎮雷旗村民委員會(以下簡稱雷旗村委會)承包地征收補償費用分配糾紛一案,不服慶城縣人民法院(2014)慶城民初字第422號民事判決,向本院提出上訴。本院受理后,依法組成合議庭公開開庭進行了審理,上訴人王劍及其委托代理人袁治業、韓永瑾與被上訴人雷旗村委會的法定代表人劉鵬、委托代理人王貴民、張步青均到庭參加了訴訟。本案現已審理終結。
 原審判決認定:王劍之父王鳳奎系慶城縣三十里鋪鎮雷旗村委會小寨自然村村民(小寨自然村原為鎮直屬村),2006年王鳳奎去世后,王劍取得繼承權,現為戶主。按王劍的土地證記載,1984年包產到戶時,王劍家承包川地8.4畝,二輪承包時王劍承包地面積調整為杏樹臺地9.6畝,沙石灘地1.85畝。2011年王劍在砂石灘地上種植槐樹數棵。三十里鋪鎮原小寨直屬村農村集體土地承包合同書記載,1998年12月31日,原慶陽縣三十里鋪鎮政府及小寨直屬村(甲方)與王劍之父王鳳奎(乙方)簽訂合同,甲方將9.6畝耕地及其附屬物承包給乙方經營,承包期限30年,從1998年12月31日至2028年12月31日。地塊名稱杏樹臺,等級80分,長89,寬72。四至邊界,東:地畔埂;南:路;西:地埂;北:地埂。面積9.6畝。
 2011年,長慶油田公司第二采油廠在小寨自然村修建采油井場,借用該自然村河岸地邊推出一條寬6米,長1100米的便道。2013年度慶城縣國土資源局(甲方)與雷旗村委會(乙方)簽訂土地征收協議,征收雷旗村委會小寨自然村土地19.86畝,其中:川臺地10.55畝,塬地7.51畝,山地1.80畝。該自然村河邊路是按川臺地標準每畝32480元征收。雙方就征地補償費用分配發生糾紛。王劍起訴請求村委會返還其1.8畝承包地的征地款59040元,樹苗補償費15000元,承擔本案訴訟費用。
 原審法院審理認為:王劍依據其承包土地證,訴請雷旗村委會將征用其土地補償金及樹苗款交付,但該村被長慶油田征用的便道是否占用王劍承包地,因小寨直屬村的二輪土地承包合同書記載的事項與王劍二輪土地承包證記載事項存在差異。《最高人民法院關于民事訴訟證據的若干規定》第77條規定:“人民法院就數個證據對同一事實的證明力,可以依照下列原則:(二)原始證據的證明力一般大于傳來證據”。土地承包合同是原小寨直屬村與王劍訂立承包合同的原始文件,王劍持有的土地證的填寫理應以雷旗村委會提交的原土地承包合同書為依據,為傳來證據。為此,對王劍提交的“土地證”本院不予采信,王劍訴請證據不足,不予支持。遂依據《中華人民共和國民事訴訟法》第六十四條之規定判決:駁回王劍的訴訟請求。案件受理費1650元,由王劍負擔。
