[Case Summary] According to Article 41 of the Rural Land Contracting Law if the contractor has a stable non-agricultural occupation or has a stable source of income with the consent of the contract-issuing party all or part of the right to manage a contracted rural land may be transferred to other farmers occupying agricultural production and management. A new contracting relationship between the farmer and the contract-issuing party is thus established and the contracting relationship between the original contractor and the contract-issuing party on the land is terminated.  一、案情簡介
 陳某與王某同為A村村民。在二輪土地延包中,王某通過家庭承包方式與A村村委會簽訂了9. 7畝耕地的承包合同。2002年,陳某與王某簽訂一份《耕地轉讓契約》,約定,王某將其家庭承包經營的9.7畝耕地中的3畝轉讓給陳某。簽訂當日,陳某即付清了轉讓款,王某也交付了土地。A村村委會在該《耕地轉讓契約》上蓋章同意。2009年,案涉土地被依法征收。陳某向A村村委會領取了被征收土地相應的土地補償費。
